Just got an email which pointed out that it's misleading to say that there are presently 33 SAUs without reorganization plans.
As the current law provides no legal future beyond June 30, 2009 for unreorganized SAUs, it's probably more accurate to say that 73 municipalities are now without reorganization plans.
And just got this below in another email, this time from the DoE:
SADs and CSDs that are out of compliance will continue to exist and function. With SAUs, it depends if they maintain the same membership. If a union splits up – that is, one or more of the units goes elsewhere, then the union no longer exists and the members must function separately or enter into an interlocal agreement to share a supt and other functions. If they all stay together – for example, they all vote no on a plan, or some yes and some no but the net effect is failure of an RSU so all of them remain out of compliance – then they can continue to function as a union. ...
The amendments in April 2008 reinstated language for SADs and CSDs, and even for unions. But the composition of these units cannot be changed because those provisions no longer exist. If you want out of a union, you need to join/create an RSU.
